General Terms and Conditions of ENGA GmbH
These General Terms and Conditions (GTC) apply to all services and products offered by ENGA GmbH (hereinafter: "ENGA"). By using the services of ENGA, you fully accept the following conditions. The privacy policy and the shipping conditions are integral and binding parts of these GTC.
ENGA reserves the right to change these GTC at any time. Changes will be made accessible on the ENGA website and will take effect upon their posting. Swiss law exclusively applies to these GTC and any disputes between ENGA and customers.
The exclusive place of jurisdiction for all disputes is the headquarters of ENGA. However, ENGA is entitled to sue customers at their domicile.
Offer
The offer is aimed at customers residing/domiciled in Switzerland or Liechtenstein. The offer is valid as long as it is visible in the online shop and/or while stocks last. Price and assortment changes are possible at any time. The images shown in advertisements, brochures, the online shop, etc. are for illustration purposes only and are non-binding.
Delivery
Upon order confirmation, a provisional delivery date will be communicated to the customer, or contact will be made with the customer to arrange an individual delivery date. If ENGA is delayed in delivery, the customer (except for custom-made products) has the right to withdraw from the contract from the 60th calendar day since the originally announced delivery date. In this case, ENGA will refund the customer any amounts already paid in advance. Further claims against ENGA do not exist.
Warranty Conditions
At ENGA, we guarantee that every product arrives in perfect condition. In addition, ENGA GmbH offers a two-year manufacturer warranty on all ENGA products. The two-year limited manufacturer warranty from ENGA does not apply to products that do not bear the ENGA brand name, even if they are packaged and sold together with ENGA products. For products not originating from ENGA, a warranty granted by the respective manufacturer may apply.
Our warranty covers the following defects: damage during transport, incomplete deliveries, or manufacturing defects.
Returns
The buyer has the right to cancel an order, return a product, or withdraw from a service contract for any reason. A buyer who wishes to return a product purchased from the ENGA shop or withdraw from a service contract must send a declaration of intent to us at any time within 30 days after the product(s) have physically come into their possession or that of a person specified by them, or after the date on which the service contract was concluded. Once the buyer has notified us of their return request, they must simply return the product along with the original payment receipt and original packaging to us within 14 days. Once the product has arrived, we will refund the buyer within 14 days the amount paid (excluding shipping costs) based on the payment method used.
If the product shows damage, we are entitled to deduct the amount of the refund by the depreciation of the product.
Payment Terms
You can choose between payment by credit card (Visa, Mastercard, American Express), invoice, and Twint. In exceptional cases, ENGA may require payment by credit card.
The VAT of 8.1% is included in all product prices. For payment by invoice, payment must be made within 14 days from the order date.
It is at ENGA's discretion to decide which payment methods are allowed and whether/when products not paid for on time will be released for sale again.
Creditworthiness
ENGA reserves the right to make the delivery of orders dependent on advance payment, the provision of security, and/or a credit check. By placing your order, you agree that ENGA may obtain this credit information. ENGA may cancel or suspend an order if you are not creditworthy or if there is a justified suspicion of fraudulent intentions.
You are entitled to revoke your consent at any time in writing.
Liability
For breaches of its own contractual obligations under these GTC, ENGA is liable to customers without limitation for direct and proven damages caused by ENGA through unlawful intent or gross negligence. ENGA expressly excludes liability for slight negligence as well as for indirect or consequential damages. Consequential damages include, in particular, lost profits, reputational damage, and data loss due to temporary impairments or interruptions in the availability of ENGA's services, as well as due to the failure of sales channels, transmission errors, delayed delivery of products, incorrect price or service information, and errors in order confirmations. ENGA is also not liable for any content on websites of organizers and other third parties that refer to the ENGA website or to which ENGA refers on its website.

In the context of fulfilling contracts, we use these payment service providers based on the Swiss Data Protection Ordinance and, where necessary, Art. 6 (1) lit. b EU GDPR. The data processed by the payment service providers includes, among other things, inventory data such as name and address, bank data such as account numbers or credit card numbers, passwords, TANs (transaction authentication numbers), and checksums, as well as contract, sum, and recipient-related information. This data is required to process transactions. However, the entered data is only processed and stored by the payment service providers.

Online Shop / Webshop
We process the data of our customers in accordance with the data protection regulations of the Federal Act on Data Protection (DSG) and the EU General Data Protection Regulation (GDPR) in the context of order processes in our online shop. This enables us to facilitate the selection and ordering of selected products and services, as well as their payment and delivery or processing.
The processed data includes master data (inventory data), communication data, contract data, payment data, and the individuals affected by the processing include our customers, interested parties, and other business partners. The processing is carried out for the purpose of providing contractual services in the context of operating an online shop, billing, delivery, and customer service. In this context, we use session cookies, e.g., to store the contents of the shopping cart, and permanent cookies, e.g., to store the login status.
The processing is based on Art. 6 (1) (b) (performance of order processes) and (c) (legally required archiving) of the GDPR. The data marked as necessary is required for the establishment and fulfillment of the contract. We only pass the data to third parties within the scope of delivery, payment, or legal permissions and obligations. Data is only processed in third countries if this is necessary for contract fulfillment (e.g., at the customer’s request for delivery or payment).
Users can optionally create a user account where they can view their orders, among other things. During the registration process, users are required to provide mandatory information. User accounts are not public and cannot be indexed by search engines such as Google.
If users cancel their user account, their data related to the user account will be deleted, provided that retention is required for commercial or tax reasons according to Art. 6 (1) (c) of the GDPR. Information in the customer account remains until it is deleted, followed by archiving if there is a legal obligation. It is the users' responsibility to back up their data before the contract ends if they cancel.
In the context of registration and re-registration, as well as the use of our online services, we store the IP address and the time of each user action. The storage is based on our legitimate interests as well as the users' interests in protection against misuse and other unauthorized use. This data is generally not shared with third parties unless necessary for the enforcement of our claims or if there is a legal obligation under Art. 6 (1) (c) of the GDPR.
Deletion occurs after the expiration of legal warranty and similar obligations, and the necessity of data retention is checked at irregular intervals. In the case of legal archiving obligations, deletion takes place after their expiration.
Data Transfer to the USA
Our website includes tools from companies based in the USA. When these tools are active, your personal data may be transferred to the US servers of the respective companies.
Please note that the USA is not considered a safe third country according to EU data protection law. US companies are required to release personal data to security authorities without you as the data subject having legal recourse against it.
